ALAN Jones has apologised publicly to PM Julia Gillard, after claiming that her late father "died of shame".
He said his comments to a Sydney University Liberal Club dinner were unacceptable, and said he had contacted the Prime Minister's office to see if she would accept a personal apology.
A spokesperson for Julia Gillard said the Prime Minister "does not intend to talk to Mr Jones about his comments".
"The comments were, in the light of everything, unacceptable," Alan Jones told a press conference in Sydney today.
"They merit an apology by me."
He said he had not considered resigning over the remarks.
"The advertisers aren?t queuing up to pull their advertising - that's up to the station," he said.
Jones said he had heard the "died of shame" remark at a children's party, and likened it to "black-humoured comments" made in the trenches of Gallipoli.
"I shouldn?t have repeated the story. I'm old enough and smart enough to know that shouldn't have happened," he said.
"It was a throw-away thing at a private function - I thought it was a private function."
Jones said he did not know there was a Sunday Telegraph journalist in the audience, or that his comments were being recorded.
"I spoke without notes for 58 minutes, I've no idea of the material I covered," he said.
Jones said that he was sober when he remade the remark.
He said he did not dislike the Prime Minister, but did dislike her policies.
Mr Jones said he'd raised money in the past for female candidates and he resented any suggestion he didn't think women should be involved in public office.
Jones added that he had been the target of Twitter trolls, who had said they wished his prostate cancer would return.
Jones issued the apology following today's Sunday Telegraph report about his speech to the Sydney University Liberal Club President's Dinner.
The dinner also featured an auction with items that included a jacket made of chaff bags autographed by Jones.
The material is a reference to the broadcaster's infamous comment that Julia Gillard should be "put in a chaff bag and thrown into the sea".
Jones bid on and won the jacket, but said the auction wasn't his idea.
The annual $100-per-head Sydney University Liberal Club President's Dinner was held on the top floor of Sydney's Waterfront restaurant in The Rocks last Saturday.
The Sunday Telegraph was present at the dinner and photographed the auction list, which also included a pair of fishnet stockings autographed by former foreign minister Alexander Downer.
During his 50-minute speech at the dinner, 2GB host and veteran broadcaster told the group of 100 Young Liberals that John Gillard's death was the fault of his proud child.

Jones went on to suggest Ms Gillard's tears of grief, for a man she publicly said she "will miss for the rest of my life", were what sparked a sudden leap in political polling for her.
The Sunday Telegraph's poll has been inundated with responses, with more than 23,600 readers saying Jones went too far with his comments.
Mr Gillard, a former psychiatric nurse, died in Adelaide on September 8, age 83.
After referring to Ms Gillard's track record with telling the truth to voters over issues including the carbon tax, Mr Jones said her father's death was caused by the Prime Minister herself.
"The old man recently died a few weeks ago of shame," Mr Jones told a group of party members and MPs, including Alex Hawke, Ray Williams and Sussan Ley.
"To think that he had a daughter who told lies every time she stood for parliament.
"Every person in the caucus of the Labor Party knows that Julia Gillard is a liar."
Some members of the audience gasped with surprise.
The radio star went on to say Ms Gillard had enjoyed a recent spike in polls sparked by her tears. He also said she was being given an easy ride by the "brainwashed" Liberal Party who had backed down because she was a woman.
Organisers of the dinner were not aware a journalist from The Sunday Telegraph, who had purchased a ticket, was present.
The Young Liberals club posted a tweet praising the speech the following day: ?brilliant speech by Alan Jones lat night.? No wonder he's the nation's most influential broadcaster! #presdientsdinner"
The tweet has since been deleted and the club tweeted this response to the controversy Jones' words sparked: ?we apologise for recent comments. Alhough out of context and not our own, they've cause offence &distracted from the national debate. AD"
The event was staged by Sydney University Liberal Club president and aspiring MP Alex Dore. Mr Jones has endorsed his political endeavours.
Yesterday, Mr Dore said Mr Jones had not made the comments about Ms Gillard's father. Later, informed there was a recording of the speech, his position changed.
"It was a very long speech and I did not hear it. I have always found Alan to be respectful," Mr Dore said.
He said there was "no need" to "pick apart Alan's speech. All you are doing is reducing it to a very small thing which distracts from the issues facing Australia".
Jones' remarks condemned
Meanwhile, Jones' remarks about the Prime Minister's late father have drawn widespread criticism.
Senior Liberal Malcolm Turnbull said the remarks were cruel and Jones should apologise.
?Alan Jones' comments about the late John Gillard were cruel and offensive. He should apologise to the PM and her family," Turnbull tweeted earlier today.
Conservative columnist Andrew Bolt condemned Jones' comments in this blog this morning.
?Those who were there and are quoted in the article deny hearing any such comment, but if it was indeed said it was very cruel, very wrong," Bolt wrote. ?
?UPDATE: No, the tape confirms it. The remark is shameful. I wish the few Young Liberals who laughed in apparent surprise or scorn had booed or otherwise protested instead.
?Alan Jones is a colleague, and I've long valued his courage. But this is very wrong," Bolt said.
Foreign Minister Bob Carr said he expected both Alan Jones and Opposition Leader Tony Abbott to apologise.
"I've heard indecent things in politics but never something as thoroughly indecent as this," Senator Carr told Network Ten.
Melbourne talkback commentator Neil Mitchell said Opposition Tony Abbott needed to take a stand on the issue.
?What Alan Jones said about Julia Gullard's [sic] late father is poisonous and disgraceful and hurtful. Australia must be above this," he tweeted earlier today.
?Tony Abbott must reject what Jones said and condemn it," the 3AW host tweeted.
Former Prime Minister Kevin Rudd tweeted: "Alan Jones' comments are lowest of the low. Abbott must dismiss Jones from Liberal Party now & ban him from future Liberal events. KRudd."

Gillard's grief
While paying tribute to her father in parliament on September 19, Ms Gillard spoke of the rough and tumble of politics and how that affected the family.
She said her father "felt more deeply than me, in many ways, some of the personal attacks that we face in the business of politics, but I was always able to reassure him that he had raised a daughter with sufficient strength not to let that get her down".
Mr Jones made several mentions about why Liberal leader Tony Abbott should be Australia's next PM.
"His overweening weakness is his humility. You will never ever hear this bloke argue his ability, his virtue, or indeed his competence," he said.
"He is a man of incomparable integrity and conviction."
The broadcaster said it was vital every member of Mr Abbott's party united behind their leader in the lead-up to the election. Mr Jones said some members of the Labor caucus were scared of the Liberal leader and others thought he was sexist.
Yesterday Mr Jones did not respond to approaches from The Sunday Telegraph.
Mr Williams would not be drawn on Mr Jones' remarks.
"I will just let this one go through to the keeper, the room was a bit a noisy at the time, I can't remember him saying it," he said.
Fellow MPs Mr Hawke and Ms Ley could not be reached.
Mr Abbott had previously expressed his condolences for the Prime Minister.
"This is a tragic time for (Ms Gillard) and we all feel for her at this very sad time," he told parliament. "It is a remarkable parent who produces a prime minister of this country."
During the five-hour event, three spoof songs were sung by Young Liberals member Simon Berger, Woolworths' government relations manager.
SACRAMENTO, Calif. (AP) ? California Gov. Jerry Brown signed legislation Friday that will create the nation's first state-administered retirement savings program for private-sector workers, over the objection of critics who said it creates a new liability for taxpayers.
The bill will establish the California Secure Choice Retirement Savings Program for more than 6 million lower-income, private-sector workers whose employers do not offer retirement plans.
The program directs employers to withhold 3 percent of their workers' pay unless the employee opts out of the savings program, which can be done every two years. It would be administered by a seven-member board chaired by the state treasurer. The board would select a professional fund manager, which could be a private investment firm or the state's public pension system, to maintain the money.
State Sen. Kevin De Leon, D-Los Angeles, introduced the bill earlier this year in response to what he called the "looming retirement tsunami" as millions of lower-wage workers face financial hardship in their retirement years. He said the program will act as a supplement to Social Security by offering private-sector workers a portable savings plan with a guaranteed return.
He said the program is not a pension but rather acts as a savings account, which could be a national model for improving retirement savings.
"This is a major step forward for retirement security in America," De Leon said in a statement. "I am grateful for Gov. Brown's acumen and with his leadership we are setting the path for middle class hard-working Americas to prepare for retirement so they won't be forced into poverty."
State Sen. Mimi Walters, R-Lake Forest, called SB1234 the "worst bill to make its way out of the legislature this year" because it would allow the state's main pension system to invest the money.
Walters noted that the California Public Employees' Retirement System is running a shortfall and that the savings program will be controlled by a group of "career politicians."
"SB1234 looks like nothing more than a cynical effort to prop up the floundering public employee pension debt with new funds from private investors," Walters wrote in a blog ahead of the bill signing.
Many cities and counties already pool their contributions along with the state in the public pension system, but taxpayers are on the hook to cover public employee benefits if investment projections fall short.
It's too soon to say what would happen if CalPERS managed the new retirement program, said pension fund's spokesman, Brad Pacheco. CalPERS could create a separate account for private-sector workers, although it's more likely to pool investments with public employees.
CalPERS' fund posted an annual return of just 1 percent last year, missing its own long-term annual target of 7.5 percent. It currently has an estimated long-term unfunded liability of $100 billion.
Democratic lawmakers said the program gives workers more savings options, particularly women working low-paying jobs. Supporters say it will not cost the state money because it will be backed by underwriters and reinsured to protect returns. De Leon noted that the money would be placed into low-risk investments with interest guaranteed at a low rate tied to long-term Treasury bond yields.
Participants would also have to sign a liability waiver stating that California would not be liable for losses.
The bill would not be implemented unless the savings program is projected to be self-sustaining and exempt from federal rules that cover private-sector defined benefit plans. Such plans have to meet minimum standards under the federal Employee Retirement Income Security Act.
The bill also requires the board to submit an annual audit. It was initially opposed by businesses, insurance companies and financial services firms. Business groups such as the California Chamber of Commerce dropped opposition after changes were made to the bill, according to De Leon's staff.
The governor also signed companion legislation under SB923.
Republican lawmakers who opposed the program when it was moving through the Legislature said low-income workers might be better off financially if they put after-tax earnings into a Roth IRA, which would allow them to take their contributions tax-free in retirement.
They also said there were too many unanswered questions about the program. GOP lawmakers said if the underwriter fails to meet investment targets, taxpayers and employers could be held responsible for covering losses and administrative overhead.
Libya's new president, Mohammed Magarief, tells NBC's Ann Curry that the recent trouble in Libya is the unfortunate price of creating a democracy after decades of dictator-rule. Magarief lived in exile for 20 years in Atlanta before returning to Libya and becoming president.

He was wanted by Libyan dictator Moammar Gadhafi, he survived seven assassination attempts and he lived in exile in Atlanta for two decades, but now that he is the new president of Libya, Mohamed Magarief says he is ready to sacrifice his life for his homeland.
"I'm determined. I'm determined to even sacrifice my life for that ... to see Libya as free, democratic," Magarief, an economist and former Libyan ambassador to India, told NBC's Ann Curry in an exclusive interview.

"I have always been ready to sacrifice my life for-- for my dream of Libya," he said.
Magarief's dream of a democratic Libya began to take shape in 1980 with the founding of the National Front for the Salvation of Libya, a group that pushed for democratic reforms in Libya and opposed Gadhafi's rule.
Magarief, who participated in the group alongside former Libyan diplomats, ambassadors and army generals, said that was his first jump into the fire.
"I started in 1980, when I decide to defect from the regime and call for, openly, for its downfall and toppling and participated with my colleagues for so many years in a very comprehensive program of action to achieve this, to topple Gadhafi and to build a new democratic Libya," he said.
Because of his open opposition of the regime, Magarief was forced into exile, first to Morocco, where Gadhafi went after his family and friends, even killing and disappearing some of those linked to him. When Morocco decided to extradite him to Libya, Magarief sought refuge in Egypt.
In an interview with NBC's Ann Curry, Libya's president Mohammed Magarief said there's 'no doubt' the attack that killed four Americans in Libya was preplanned, and not a result of the controversial anti-Islam movie that sparked violent protests.
He lived in Egypt for seven years, but had to seek refuge yet again when former Egyptian leader Hosni Mubarak wanted to send him back to Libya, where he was still wanted. In 1991, Magarief and his family moved to Atlanta, where he lived until Gadhafi was toppled in October, 2011.
"I didn't leave home to stay for good in Atlanta. I left my home to return, to hope to return to it after it's liberated from Gadhafi. Having? being liberated now, it's my duty to, it's my dream and my hopes to return to my home, Libya, and to die there, to be buried in Libya," he said.
A transitional leader Libya's national assembly picked Magarief as its president in August. He is the leader of the National Front party, an offshoot of the old opposition movement he helped start. Magarief, who is from Benghazi, won 113 votes against independent Ali Zidan, who got 85 votes.
The path Magarief envisions for Libya includes free and open elections and a new constitution. He said he has no desire to stay in power beyond the transitional period, and hopes his successor will be a democratically elected leader. Magarief disagrees with the idea that fundamentalists will be allowed to fill the power vacuum in Libya following the toppling of Gadhafi, adding that Libyans will stand against extremist views.
"These fundamentalists, these extremists, these trends that are, first of all, it has nothing to do with true Islam, real Islam," he said. "The interpretation that these people introduced is not accepted by majority of Muslims."
Magarief discounted claims that the deadly attack on the U.S. consulate in Benghazi earlier this month was in response to an anti-Islam movie produced in California and available on YouTube. He noted that the assault happened on Sept. 11 and that the video had been available for months before that.
"Reaction should have been, if it was genuine, .... six months earlier. So it was postponed until the 11th of September," he said. "They chose this date, 11th of September to carry a certain message."
"We consider the United States as a friend, not only a friend, a strong friend, who stood with us in our moment of need," he added.
Magarief admitted it would not be easy for Libya to shake off the legacy that decades of Gadhafi's dictatorship has left behind, but he strongly believes that every country deserves to enjoy democracy.
"This should not continue. If it continues, we'll all pay a heavy price. The solution is freedom, is democracy," he said. "Giving people the chance to -- and I'm sure we'll mature. We'll mature quickly, very quickly. And we'll prove that we are responsible human beings, who deserve freedom and democracy."

Karl Gustav, Nemo Aguila, Russel and Epjey Pacheco have come together in support of the Jeepney Art Festival, a project of Hop-On Hop-Off Travel Inc.. operating jeepney tours in the metro.
The said contest, held at the SM Mall of Asia, offered as much as 30,000 pesos as reward for the winning design.
?The jeepney is a very practical form of transportation. We cannot imagine Manila without the jeepney?, Epjey, who goes by his artist alter-ego ?Egg Fiasco?, says in Filipino.
Epjey adds they were not really after the cash prize but moreso, because they are all fascinated at ?jeepney art?. They also considered this event as an ?art jam? and bonding moment since they all live together.
They also consider the Jeepney Art Festival as their means of training as graffiti artists. ?This is sort of our version of graffitti you can find in train or subway stations in New York,? Epjey adds.

ScienceDaily (Sep. 28, 2012) ? Research undertaken by the University of Southampton and its associates in Venice has revealed that the sea surface temperature (SST) in coastal regions is rising as much as ten times faster than the global average of 0.13 degrees per decade.
Researchers believe that this is partly as a result of a process known as the 'urban heat island effect'; where regions experiencing rapid industrial and urban expansion produce vast amounts of heat, making the area warmer than its surroundings.
Professor Carl Amos of Ocean and Earth Sciences at the University of Southampton, will be making a speech at the Estuarine & Coastal Sciences Association's Research & Management of Transitional Waters international symposium, in Lithuania on September 27. He explains: "The urban heat island effect is a little considered problem with extreme consequences. Take London for example; the air temperature in the capital and the SST of the Thames is always warmer than it is in the rest of the UK. Similarly, in South Korea, an area which has seen rapid industrial expansion, the SST is rising at a rate of 0.26 degrees per decade -- significantly higher than the global average. Two thirds of this rise is explained by local air temperature, which is largely driven by the urban heat island effect."
The world's coastal zone occupies 18 per cent of the world's land mass and it is estimated that 1.6 billion people live in these regions world-wide. The coastal population density is three times the global average and this population is expected to increase 30 per cent by 2025, with trade and infrastructure at the coasts also increasing steadily. Research suggests that in coastal regions of high urban development, human activity is directly warming adjacent coastal waters and that this contribution to global warming at the coastal zones is equal to, or greater than, other factors such as greenhouse gasses.
Professor Amos, who is based at the National Oceanography Centre Southampton (NOCS) says: "The Marine Climate Change Impacts Partnership Report of 2006 stated that the capacity to define and predict long-term coastal changes due to human causes is 'unknown' and confidence in results is 'low'. This is a major barrier to planning for inevitable changes in coastal SST. Most of these changes at coastlines are caused by human activity, but as it is complex to consider these factors accurately, the official International Panel for Climate Change (IPCC) figures do not take these coastal 'anomalies' into account."
In Venice, with 22 million visitors annually and tourism a year-round source of income, the economy remains critically dependent on the city maintaining its status as one of the world's most desirable destinations. Southampton's research in Venice has highlighted the tension between tourism's economic benefits and environmental repercussions. Analyses of seawater temperature trends in the Venice Lagoon have suggested an increase during winter months ten times greater than that predicted globally by the IPCC -- a result directly linked to tourism.
Thousands of jobs and the Venetian economy rely on the survival of the fishing industry, which is dependent on the temperature of the coastal seawater in the Venice Lagoon. A rise in SST in the coastal zone reduces oxygen levels and displaces marine fish and associated nursery grounds, causing catastrophic fish kill phenomena. This research has helped predict the viability of clam fisheries and aquaculture habitats that serve the restaurant trade that caters for millions of tourists every year.
Professor Amos says: "The findings in Venice are the result of a 15 year partnership with the city, which are of great importance and have worldwide applications. Massive urbanisation of the coastal zones means urban heat islands represent an acute problem, particularly for the fishing industry and also for the maintenance of coastal infrastructure. The Thames, like the Venice Lagoon, is a major contributor to and casualty of the urban heat island effect. The consequences of the urban heat island effect need addressing urgently to secure the future of our coastal habitats."

Top advisers are both relishing in Obama's edge in key battleground state polling and warning it can change in an instant. They're wary of the many factors that still could derail the Democrat's campaign, from simmering tensions in the Middle East to the three high-stakes presidential debates. They're worried, too, about a flood of negative advertisements from Republican-leaning outside groups and potential complacency among Democratic voters and volunteers who think the race is a lock for Obama.
Also weighing on them: unforeseen domestic or international events that can shake up a close race in the homestretch.
"I can only worry about what I can control," says Jim Messina, Obama's campaign manager.
For now, that means the overall campaign strategy.
Yet, even there, Obama's team is being careful: the Democrat is considering making a late play for traditionally Republican Arizona ? either to win it or to force rival Mitt Romney to spend money to protect GOP turf ? but advisers are weighing the potential that a move like that could backfire by leaving fewer resources for more competitive states.
With just over 40 days until the election and with many states already voting, public and internal polls show Obama leading Romney in many of the eight or so battleground states that will determine the election. But both campaigns are mindful that much can happen in the homestretch, and advisers for each candidate expect the numbers to tighten as more voters tune into the race in the final weeks. By the day, both sides are adjusting their strategies in key states and monitoring how, in voters' eyes, signs of growth in the economy square with an unemployment rate that remains above 8 percent.
The race had been deadlocked until recently when Obama edged ahead in polling after his convention. Even so, neither candidate has been able to put the race out of reach of their opponent, despite the sluggish economy Obama has presided over and a series of missteps by Romney.
At Obama's Chicago campaign headquarters, the mood underscores the balance the campaign is trying to strike: optimism about the trajectory of the race with cautiousness about all the things that could shift the dynamics.
Obama aides are focused on bolstering get-out-the-vote operations in battleground states to buffer against any late shifts in the race, countering negative ads by a crush of Republican-leaning super political action committees ? and living by the mantra of not making too much out of any one poll or event.
Last week, campaign staffers were ordered to be restrained in their response and avoid appearing as though they were declaring victory prematurely when a video surfaced showing Romney telling wealthy donors that 47 percent of Americans believe they are victims. And earlier this month, the campaign sought to keep its focus on the economy, the No. 1 issue for voters, rather than get dragged into a foreign policy debate after a U.S. ambassador and three other Americans were killed in Libya.
The worry about next week's presidential debate ? the first of three in as many weeks ? is clear at the downtown high rise that houses Obama's campaign inner circle and hundreds of staffers. On Oct. 3, most Americans will for the first time see the two men standing side by side, a visual that could make Romney seem more presidential to some voters. And the high-stakes showdowns always carry the potential for a slip-up that can be hard to recover from just weeks before Election Day.
Obama has spent the past few weeks preparing for the debates, though advisers won't say much about it ? other than to try to lower expectations for Obama and raise them for Romney.
Advisers argue that the debate format ? limited to 90 minutes ? works against the sometimes long-winded Obama, who they cast as the underdog on a debate stage.
As Obama adviser Robert Gibbs put it in a CBS interview: "Mitt Romney, I think, has an advantage because he's been through 20 of these debates in the primaries over the last year. He even bragged that he was declared the winner in 16 of those debates."
For all the concerns, even the most anxious Obama aides take some measure of comfort in an Electoral College map that favors the president. He has more pathways to victory than Romney, whose route to the White House becomes all but impossible without a victory in Florida, where polls show the race is tight, or Ohio, where Obama has pulled ahead in surveys.
Signaling confidence, Obama's team is considering competing in Arizona.
Obama looked at competing in Arizona in 2008, but decided against it because of the support there for home state Sen. John McCain, the GOP nominee. Obama still won 45 percent of the vote.
This year, Obama's team talked early on about running in Arizona, which offers 11 electoral votes, but it never did. Now, with an internal Democratic poll showing Obama narrowly leading Romney, Obama's team might make a play for the state that has seen a 160,000 increase in voter registrations by Democratic-leaning Hispanics over the past four years.
Buying television time in Phoenix, the state's largest city, is expensive and Obama advisers are closely watching their finances.
That's not to say that competing in Arizona would be all about winning: going up on the air in the state ? or sending the president in to campaign there, could force Romney to spend valuable resources defending a state he should be able to count on in the quest to reach 270 Electoral College votes needed for victory.
CLEVELAND (AP) - Ryan Fitzpatrick threw three touchdown passes and the Buffalo Bills overcame the loss of running back C.J. Spiller to beat the Cleveland Browns 24-14 on Sunday, snapping an eight-game road losing streak.
Fitzpatrick finished 22 of 35 for 208 yards as the Bills (2-1) turned to their passing game after Spiller, the NFL's leading rusher, was lost in the first quarter with a shoulder injury.
The Bills hadn't won outside Buffalo since the 2011 season opener at Kansas City.

The first person in line at Apple's flagship store in New York City is Hazem Sayed, the developer behind Vibe, an?app that lets its users broadcast anonymous messages to those nearby. He has spent well over a week sitting in front of the Apple Store on 5th Avenue and he does not regret a moment. "I'm as happy as I am tired," he tells reporters who crowd him as soon as he exits the store with his new?iPhone 5?in hand.
When asked whether he even has the energy to use his new smartphone after the long wait, Sayed smiles. "It's love at first sight," he says. "I'll stay up all night."
Love at first sight isn't eternal though. Sayed says he would consider selling his new gadget for twice what he paid, meaning about $1600 total. "The receipt is longer than the phone," he remarks absentmindedly as he holds up a crumpled slip of paper next to the device. He bought a black 64GB AT&T version of the iPhone.
Long after Sayed managed to escape the clutches of reporters, cheers continued?erupting?each time someone exited the Apple Store, with a new iPhone 5 in hand. The applause could be heard for blocks.

Much to the dismay of many, the new operating system does not offer a Google-powered Maps app, but instead uses Apple's own creation (which is not earning much praise so far).

CENTENNIAL, Colo. (Reuters) - Prosecutors dropped their legal fight on Thursday for access to a notebook that accused Colorado theater gunman James Holmes sent to a university psychiatrist before the shooting, saying legal wrangling over it would delay the case for months.
Holmes, a former neuroscience graduate student, is accused of opening fire on July 20 at a midnight screening of the Batman movie "The Dark Knight Rises" in Aurora, a Denver suburb. Twelve people were killed and 58 wounded in the attack.
"There's a high degree of likelihood that whatever privilege exists in the notebook will end up being waived by the defendant" should Holmes' lawyers pursue an insanity defense, prosecutor Rich Orman said during a hearing on the issue.
Arapahoe County District Judge William Sylvester also approved 10 new felony charges of attempted first degree murder filed by prosecutors against Holmes, 24, and allowed 17 current charges to be amended.
But Sylvester has ordered nearly all court filings in the case sealed, and the exact changes were not immediately clear as the documents outlining them were redacted.
A spokeswoman for the District Attorney's office declined to clarify the new and amended charges, citing a gag order. A spokesman for the court also declined to comment.
Holmes already faced 24 counts of first-degree murder and 116 counts of attempted murder. Under Colorado law, the doubling of charges allows prosecutors two potential pathways to secure a conviction.
Orman said at a hearing last month that Holmes bought a ticket to the midnight screening, then left the theater through an exit door he propped open on his way out. Holmes then put on a gas mask and ballistic protective gear before returning to the theater and spraying the crowd with gunfire, Orman said.
'A BAD DAY FOR JAMES HOLMES'
Holmes appeared in court on Thursday with close-cut brown hair, leaving no trace of the orange mop of curly hair that had marked his appearance following his arrest. He looked around the courtroom more than in earlier appearances, but was not very expressive during the hearing.
"This was a bad day for James Holmes because it may have taken a year off his life," a former Denver prosecutor now in private practice, Craig Silverman, said of the hearing, noting Holmes is eligible to face the death penalty if convicted. Prosecutors have not indicated if they will pursue capital punishment.
University of Colorado psychiatrist Lynne Fenton testified at an earlier hearing that she treated Holmes more than a month before the rampage, but that their professional relationship had ended before he mailed the package to her a day before the massacre.
Holmes' lawyers said the package and its contents were confidential and should not be seen by prosecutors. The defense team can analyze the notebook only under rigorous evidence collection precautions, including wearing gloves and face masks.
Prosecutors have depicted Holmes as a young man whose once promising academic career was in tatters as he failed graduate school oral board exams in June and one of his professors suggested he may not have been a good fit for his competitive Ph.D. program.
They have said that Holmes lost his access to the University of Colorado Anschutz Medical Campus after making unspecified threats to a professor on June 12, after which he began a voluntary withdrawal from his program.
They said Holmes began "a detailed and complex plan" to commit murder and obtain an arsenal of guns and protective armor after he was denied access to campus facilities.
Holmes' attorney Daniel King, who analysts said appeared to be laying the groundwork for a possible insanity defense, has said his client suffers from an unspecified mental illness and had tried to get help before the shooting.
Previous media reports have said Fenton reported her concerns about Holmes to a campus threat assessment team and a campus police officer.

Goodwill Industries of the Chesapeake opening new outlet store in Rosedale
Goodwill Industries of the Chesapeake will open a new outlet store on Wednesday in Rosedale. This is the 28th store in the Baltimore area for the nonprofit, which provides job training and placement programs for people with disabilities or other physical, mental or disadvantaged social conditions. The new location marks the ninth retail store Goodwill has in Baltimore County, and the third outlet store. Community residents will be able to donate unwanted clothing and household items at the retail location. Outlet stores offer consumers the chance to purchase items priced per pound, instead of the usual price per item. Items available include shoes, handbags, clothes and more. The new Rosedale outlet store at 6255 Kenwood Ave. will create five new jobs. Goodwill Industries of the Chesapeake also operates an e-books store where consumers can go online to purchase books. The operations for the Goodwill Good Books store will be moved to the new Rosedale outlet store, creating an additional three jobs.
New apartment development emphasizes eco-friendliness
Fore Property Co., a Washington-based national apartment developer and manager, said its newest community, Groveton Green Apartments in Owings Mills, will be open for occupancy next month. The $35 million, 226-unit development is the first and only LEED Gold-designed multifamily development in the Owings Mills area. ?Residents get the benefit of reduced energy and water costs, lower carbon and pollution footprint, and healthier living from cleaner air without having to lift a finger,? Fore Vice President Jim Sullivan said in a prepared statement. The gated community?s green features include energy efficient windows, Energy Star appliances and lights, high-efficiency HVAC units and enhanced insulation. High-capacity MERV 8 air filters provide cleaner fresh air, along with eco-friendly carpeting and low volatile-organic compound paints. More than 50 acres on three sides of the development are dedicated to forest conservation, forest buffer, recreational greenway and other natural preserve.
First Sheraton opens in Silver Spring
Starwood Hotels & Resorts Worldwide Inc. announced the opening of the Sheraton Silver Spring hotel. Owned by Los Angeles-based Integrated Capital LLC, a hotel-focused, private real estate advisory and investment firm, the former Crowne Plaza has undergone an extensive renovation and conversion costing more than $5 million to bring it up to Sheraton standards. This is the first Sheraton-branded hotel in the suburban Washington community. The hotel offers 229 refurbished guest rooms and nearly 16,000 square feet of flexible meeting space with the latest in meetings technology. Additional amenities include a full-service restaurant and lounge, outdoor pool and fully equipped fitness facility.
SHA repairs Inter-County Connector bridges
(AP) Maryland State Highway Administration officials said crews are working to repair cracks found in overpasses on the Inter-County Connector. SHA inspectors have discovered cracks on 10 bridges along the new $2.5 billion toll highway. David Buck, a spokesman for the agency, said half of those cracks were found last year. Buck said the overpasses are still safe for motorists to use. The Washington Examiner was first to report on the existence of two of the most recently discovered cracks.
SHA to get grant for Walter Reed access
The Maryland State Highway Administration is to receive a $7.3 million grant from the Department of Defense to construct improvements at the intersection of Maryland Route 187 and West Cedar Lane/Oakmont Avenue in Bethesda. The money will be used to improve access to the Walter Reed National Military Center and reduce congestion in the surrounding community related to Base Closure and Realignment Commission consolidation. This is the first of four grants expected to be awarded to the Maryland Department of Transportation for this purpose, according to the announcement by Sens. Barbara Mikulski and Ben Cardin, and Rep. Chris Van Hollen, all Democrats.
Historic farm seeks life-long curator
(AP) Maryland officials are offering a lifetime lease to the historic Grove Farm in Cecil County in exchange for restoring and maintaining it. The Department of Natural Resources held an open house on Saturday and scheduled another for Oct. 13. The farm near Earleville is part of a state program that matches historic properties with those interested in restoring and maintaining them. The farm sits on 750 acres of protected farmland and woodland. The restoration will cover the Federal-style main house built around 1810, as well as other buildings. DNR officials said preference will be given to proposals from nonprofits with missions similar to theirs.
1st JW Marriott hotel in New York opens
Marriott International Inc., of Bethesda, the largest publicly traded hotel chain in the U.S., announced the opening of the JW Marriott Essex House New York, the brand?s first hotel in New York City. The hotel is located on Central Park South in midtown Manhattan, close to Central Park and Fifth Avenue?s shopping, dining and entertainment. Formerly the Jumeirah Essex House, the landmark hotel features 509 guestrooms and suites ranging from 300 to 2,500 square feet. The iconic Essex House first opened its doors in October 1931. Marriott International operated the hotel from 1969 to 1984.
Maryland House murals to be preserved
(AP) The state is planning to preserve a set of murals that have decorated a shuttered travel plaza near Aberdeen for more than 40 years. The pair of four-panel murals from the Maryland House on Interstate 95 will be kept in a climate-controlled fine-art storage facility because of their historic and artistic value, The Baltimore Sun reported. The murals painted by William A. Smith depict significant events and people in Maryland history. They were commissioned in 1966 and installed in 1968. The Maryland House is being rebuilt, but a Maryland Transportation Authority spokeswoman said the murals won?t be installed there. She said the agency has no plans for displaying the works.
Marriott to operate Bronx luxury hotel
Marriott International Inc., of Bethesda, the largest publicly traded hotel chain in the U.S., has signed an agreement with Bronx, N.Y.-based Simone Development Cos. to operate a luxury hotel under the Residence Inn brand at a new mixed-use project in the Bronx. Simone is developing the 370,000-square-foot office/retail/hotel complex called Metro Center Atrium as an addition to its 42-acre, multi-building Hutchinson Metro Center campus in the Pelham Bay section of the Bronx. The new Residence Inn at Metro Center Atrium will be the first luxury hotel to open in the Bronx. The 125-room extended-stay hotel is scheduled to open in 2014.
Proposed incinerator size uncertain
(AP) Frederick County officials say they?re considering downsizing a proposed trash incinerator due to uncertainty about Carroll County?s participation in the project. Frederick County Commission President Blaine Young told The Frederick News-Post Tuesday that the county would be ?crazy? to build a 1,500-ton-per-day facility without a partner to share the cost. Carroll County has been seeking alternatives to participating in the $368 million project. It had agreed to be a 40 percent partner. Young said Frederick County officials need to study the situation before making any decision about changing the size of the project.
Developer seeks to buy Owings Mills mall
(AP) A Pikesville-based realty company is seeking to buy the Owings Mills Mall. Carl Verstandig, president and CEO of America?s Realty LLC, said he made an offer to Kimco Realty for the site. Verstandig said he would demolish much of the mall, and is considering opening a discount supermarket there. The Baltimore Sun reported that Kimco and its partner, General Growth Properties Inc., had planned a $65 million revitalization of the mall. But after an upscale shopping center was proposed nearby, Kimco indicated that it might drop the plan because the market couldn?t support so much retail.
European hotels to join Autograph brand
Marriott International Inc., of Bethesda, the largest publicly traded hotel chain in the U.S., announced plans to add three European hotels to its Autograph Collection brand by the end of the year. The hotels are the Fontecruz in Lisbon, Portugal; the Hotel De Bourgtheroulde in Rouen, France; and the Hotel L?Hermitage Gantois in Lille, France. Autograph Collection consists of upper, upscale and luxury, independent hotels with distinctive personalities in major cities and desired destinations worldwide. Autograph Collection hotels can access Marriott?s global reservations system and technology, sales and marketing platforms. The additions will expand the Autograph Collection to 12 hotels in Europe, and 40 worldwide.
Hagerstown stadium funding clouded
(AP) A $15 million private donation toward construction of a downtown minor league baseball stadium in Hagerstown isn?t assured, the Herald-Mail newspaper reported. Councilman Lewis Metzner told the newspaper that the city hasn?t confirmed that the prospective donor has the money. He said private sector funding is crucial to securing $10 million from the state for the $30 million project. This month, Metzner said the city had a verbal commitment from the Pennsylvania man, whose identity hasn?t been disclosed. The stadium would house the Hagerstown Suns, a Class A affiliate of the Washington Nationals.
Easton eyes waterfront site for new park
(AP) Easton is considering turning an 11-acre public works storage site into a new waterfront park, the Star-Democrat of Easton reported. The proposed Easton Point park on the banks of the Tred Avon River would have outdoor classrooms, an amphitheater, boardwalk, living shoreline and marina. Plans also call for a kayak launch and a pedestrian bring across a river tributary to an adjoining neighborhood. The Eastern Shore Land Conservancy presented plans for the park to the Town Council this week. The park would sit on an area currently used as a public works department equipment and supply storage site.

Greenberg Gibbons of Owings Mills announced that it has named Eric Walter as senior vice president, acquisitions and finance. Walter will be responsible for overseeing acquisition opportunities and all areas of project finance for the retail development company. Before joining Greenberg Gibbons, Walter worked for CBRE?s Washington office in the National Retail Investment Sales Group. During his tenure at CBRE, he was responsible for the financial underwriting, market analysis and due diligence for retail properties in the mid-Atlantic region, closing more than $1 billion in retail investment sales transactions. Walter is a member of the International Council of Shopping Centers and Urban Land Institute.

Trout Daniel & Associates, a full-service commercial real estate company, announced the lease of 4501 Curtis Avenue, a 54,000-square-foot building in Baltimore, to Chesapeake Compost Works Benefit LLC. Centrally located in a heavy industrial business community, the property will be used to operate a green industrial recycling facility that converts organic waste materials into compost, the largest of its kind in Maryland. Steven L. Cornblatt, principal at Trout Daniel, represented the tenant in the transaction. Toby Mink of BTR Curtis LLC represented the landlord. The facility will open on Oct. 1, following minor tenant improvements to the property. A new aeration system is being installed to completely manage the composting process and eliminate odors. Approximately 10 new jobs will be associated with the composting operations.
Cassidy Turley?s Baltimore office announced that DuClaw Brewing Co. signed a lease for 62,962 square feet at 8901 Yellow Brick Road in Rosedale. A craft brewery, DuClaw will locate its headquarters and brewery at the site. DuClaw plans to begin beer-brewing in the building early next year and will hire up to 35 people for production, distribution, sales and marketing. Jarred Testa and Tilghman Herring with Cassidy Turley?s Baltimore Core Industrial Leasing Team represented the building owner, RREEF, in the transaction. The tenant was represented by Dave Dannenfelser with Colliers International.
